The rules that govern use of our website and mobile mechanic services.
1. Agreement to Terms
By accessing or using the Ditch The Shop website (ditchtheshop.com) or any of our mobile mechanic services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our website or services.
2. Services
Ditch The Shop LLC provides mobile auto repair and maintenance services. Our mechanics travel to your designated location to perform repairs on your vehicle. Services include but are not limited to brake repair, oil changes, battery replacement, alternator and starter replacement, spark plug replacement, diagnostics, and suspension work.
We reserve the right to decline any service request if we determine the repair cannot be safely or properly completed at your location, or if the vehicle condition presents safety concerns for our technicians.
3. Quotes and Pricing
All quotes provided through our website, text messages, or phone calls are estimates based on the information you provide about your vehicle. While we strive for accuracy, final pricing may vary if the actual condition of your vehicle differs from what was described.
If additional work is needed beyond the original quote, we will notify you and obtain your approval before performing any additional repairs. You are never charged for work you did not authorize. The quoted price includes parts, labor, and all applicable fees unless otherwise stated.
4. Appointments and Scheduling
Appointment times are scheduled based on availability and are subject to change due to weather, prior job delays, or unforeseen circumstances. We will communicate any changes to your scheduled appointment as soon as possible.
We ask that you provide a safe, accessible workspace for our mechanic. This includes a flat, stable surface with adequate room to work around the vehicle. If the work location is unsuitable or unsafe, we reserve the right to reschedule or decline the service.
5. Cancellations and Rescheduling
You may cancel or reschedule an appointment at any time. We appreciate as much advance notice as possible, especially if parts have already been ordered for your specific vehicle. There are no cancellation fees.
If parts have been specially ordered and cannot be returned, you may be responsible for the cost of those parts. We will communicate this clearly before ordering any non-returnable items.
6. Payment
Payment is due upon completion of the repair. We accept all major credit cards, debit cards, and cash. No payment is collected until the work is completed and you have had the opportunity to review the repair.
If payment is not received upon completion, Ditch The Shop reserves the right to pursue collection of the outstanding balance including any applicable fees and costs.
7. Customer-Supplied Parts
If you choose to supply your own parts, we will install them at your request. However, customer-supplied parts are covered by a reduced warranty of 3 months on labor only. We do not warranty parts we did not supply. For full warranty coverage (12 months / 12,000 miles on parts and labor), we recommend using parts sourced by Ditch The Shop. 8. Warranty
All repairs performed by Ditch The Shop using our parts are backed by a 12-month / 12,000-mile warranty covering both parts and labor. Repairs using customer-supplied parts carry a 3-month labor-only warranty. Full warranty terms, conditions, and exclusions are detailed in our Warranty Policy.
9. Limitation of Liability
Ditch The Shop's total liability for any claim arising from our services shall not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages including but not limited to loss of use, lost profits, or damage to other property.
We are not responsible for pre-existing conditions, damage, or defects in your vehicle that are unrelated to the services we performed. Our mechanics will document the condition of your vehicle before beginning any work.
10. Vehicle Access and Condition
You represent that you are the legal owner of the vehicle or have authorization from the owner to request service. You are responsible for accurately describing your vehicle and the services requested.
You acknowledge that your vehicle may have pre-existing conditions or wear that are not related to the service being performed. Our mechanics may identify additional issues during the repair. These findings will be communicated to you, and no work will be performed without your consent.
11. Intellectual Property
All content on the Ditch The Shop website — including text, graphics, logos, images, and software — is the property of Ditch The Shop LLC and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content without our written permission.
12. Website Use
You agree to use our website for lawful purposes only. You may not use the site to transmit harmful, offensive, or misleading content, attempt to gain unauthorized access to any systems, or interfere with the website's operation.
We reserve the right to modify, suspend, or discontinue any aspect of the website at any time without notice.
13. Indemnification
You agree to indemnify and hold harmless Ditch The Shop LLC, its owners, employees, and contractors from any claims, damages, losses, or expenses (including attorneys' fees) arising from your use of our services or website, your violation of these Terms, or your violation of any rights of a third party.
14. Dispute Resolution
Any disputes arising from these Terms or our services shall be governed by the laws of the State of South Dakota. Both parties agree to first attempt to resolve any dispute informally by contacting each other directly. If a dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration or the courts of South Dakota.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Changes to Terms
We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website or services after any changes constitutes acceptance of the new Terms.
